Terms of Service

These Terms of Service ("Terms") govern your use of withinly.org (the "Site") and your purchase of products from Withinly ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms.

1. General

We may update these Terms from time to time. The version published on the Site at the time you place an order applies to that order. If you do not agree with these Terms, please do not use the Site.

2. Products and descriptions

We take care to describe and photograph our products accurately. Minor variations in colour and finish may occur due to screen settings and the handmade or manufactured nature of materials. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

3. Orders and acceptance

Your order is an offer to purchase. We accept it when we send you an order confirmation email. We may decline or cancel an order where a product is unavailable, where we reasonably suspect fraud, or where there has been a pricing or description error; if payment has been taken for a cancelled order, we will refund it in full.

4. Pricing and payment

All prices are in Australian Dollars (AUD) and include GST where applicable, unless stated otherwise. Shipping costs are additional and shown at checkout. We may change prices at any time, but changes will not affect orders already confirmed. If a product is listed at an obviously incorrect price due to an error, we may cancel the order and refund you.

5. Discount codes

Discount codes apply only during their stated validity period, cannot be exchanged for cash, and cannot be combined with other codes unless we say otherwise. We may withdraw or modify promotional offers at any time; this will not affect orders already placed.

6. Shipping and risk

Shipping is governed by our Shipping Policy. Delivery timeframes are estimates only. Risk in the products passes to you on delivery to your nominated address; title passes on receipt of full payment.

7. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these Terms. Your rights under the Australian Consumer Law apply in addition to anything in that policy.

8. Our products are not a substitute for professional advice

Our journals and accessories are wellbeing and lifestyle products. They are not medical or therapeutic devices, and nothing on the Site is medical, psychological or professional advice. If you have concerns about your health, including your sleep or mental health, please consult a qualified professional.

9. Intellectual property

All content on the Site — including the Withinly name, logo, product designs, photographs and text — is owned by or licensed to us. You may not reproduce or use it for commercial purposes without our written permission.

10. Acceptable use

You must not use the Site for any unlawful purpose, attempt to interfere with its operation, or submit false or misleading information (including when placing orders or leaving reviews).

11. Liability

To the extent permitted by law, and subject always to your rights under the Australian Consumer Law, we exclude liability for indirect or consequential loss arising from your use of the Site or products. Where liability cannot be excluded but can be limited, our liability is limited to resupplying the product or refunding the price paid, at our election.

12. Governing law

These Terms are governed by the laws of [your State/Territory, e.g. Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
